Acceptable Usage Policy
Customer agrees when using, or accessing hostBD.net's services that the
following terms and conditions of this policy will be met.
Acceptable Usage Policy
01. User agrees to use the service in manner consistent with any and all
applicable laws. In the event that this account is not used in accordance with
all Applicable Laws including, but not limited to Local, State or Federal Laws,
hostBD.net reserves the right to cooperate with all or any law enforcement
agencies.
02. User agrees to follow the Acceptable Use Policy of any network user connects
to, including hostBD.net's system.
USAGE OF hostBD.net SERVICES
03. Use of hostBD.net's service requires a certain level of knowledge in the use
of Internet languages, protocols, and software. This level of knowledge varies
depending on the anticipated use and desired content of Client's web space by
the Client. The following examples are offered:
- Web Publishing: requires knowledge of HTML, properly locating and linking
documents, FTPing Web contents, Graphics, text, sound, image mapping, etc.
- FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet
and FTP understanding and capability.
- CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP
commands, Perl, CShell scripts, permissions, etc.
- Autoresponders: a knowledge of Procmail auto-responder features, forwarding
mail, use of mail clients to receive and send mail, etc.
NOTE: hostBD.net does NOT provide support for third party scripts,
databases or other related stuff. However our expert technical staff will help
you to sort it out, but this is just as a favor.
04. Client is allowed to resell the storage and transfer services provided by
hostBD.net. Client agrees to handle and is responsible for all third-party
customer's content, support, setup and maintenance. hostBD.net agrees to
Reseller pricing as described on the Price and Terms Sheet, provided that client
has at least one other non-resold account with hostBD.net. Client agrees to
having the necessary additional knowledge and skill level for the reselling
services provided. The Client's clients shall not contact hostBD.net under any
circumstances.
PAYMENT ISSUES
05. User agrees to pay hostBD.net all charges relating to the use of User's
account(s) according to rates and prices stated on said sales order at the time
of commencement.
06. User is responsible for charges at the time the service is used and
hostBD.net may apply the amount due to User's credit card at any time.
07. hostBD.net reserves the right to suspend access to service for User's
account(s) upon an indication of credit problems including delinquent payments
or rejection of any credit card charges.
08. Neither hostBD.net nor its Information Providers are responsible for any
damages arising from User's use of hostBD.net or by User's inability to use
hostBD.net service.
09. Dues must be paid on a timely basis. Dues charges will continue regardless
of your use unless and until you notify us in writing that you wish to cancel
your membership at the end of your contract period. 30 days cancellation notice
prior to the end of your current term is required. You can cancel your
membership within your first 30 days and receive a full refund on your monthly
fees. After the first 30 days you can still cancel your account but cancellation
will become effective at the end of your current contract period and no partial
refunds will be given.
10. hostBD.net reserves the right to collect damages (software, hardware & man
hours) if any harm is done to hostBD.net which requires repair or
reconfiguration of any kind.
11. Credit Card payment: If Customer chooses to pay for services by credit card,
Customer grants hostBD.net Internet Services the right to charge payments to
that card on each due date. Customer further agrees not to challenge nor dispute
any charge representing hosting payments.
IMMEDIATE SUSPENSIONS
12. The following violations of "etiquette" are grounds for immediate suspension
of service pending investigation by hostBD.net and will result in termination of
the account(s) the investigation determines to have originated or transmitted
these types of traffic.
(a) Posting a single article or substantially similar articles to an excessive
number of newsgroups (i.e., 20 or more) or continued posting of articles which
are off-topic (e.g., off-topic according to the newsgroup charter or the article
provokes complaints from the regular readers of the newsgroup for being
off-topic).
(b) Sending unsolicited mass e-mailings (i.e., to more than 25 users) which
provoke complaints from the recipients.
(c) Engaging in either (a) or (b) from a provider other than hostBD.net and
using an account on hostBD.net as a mail drop for responses, or advertising a
web site hosted at hostBD.net.
(d) Continued harassment of other individuals on the Internet after being asked
to stop by those individuals and by hostBD.net.
(e) Impersonating another user or otherwise falsifying one's user name in
e-mail, Usenet postings, on IRC, or with any other Internet service. (This does
not preclude the use of nicknames in IRC or the use of anonymous re-mailer
services.)
13. Users whose accounts are terminated for any of the above infractions are
also responsible for the cost of labor to cleanup and respond to complaints
incurred by hostBD.net.
14. User hereby agrees that any material submitted for publication on hostBD.net
through user's account(s) does not violate or infringe any copyright, trademark,
patent, statutory, common law or proprietary rights of others, or contain
anything obscene or libelous. Software intended to facilitate any such
violations or infringements may not be stored on hostBD.net.
15. hostBD.net, at its sole business judgment, may terminate this membership
Agreement immediately or suspend User's access to the service upon any breach of
this membership Agreement by User, including, but not limited to, refusal or
failure to pay for services provided or by sole judgment of hostBD.net that User
may be performing activities harmful to hostBD.net or its Users, employees,
vendors, business relationships or any other users of the Internet.
HIGH RESOURCE USER POLICY
16. Resources are defined as bandwidth and/or processor utilization. hostBD.net
Web Hosting Solutions may implement the following policy to its sole discretion:
When a web site is found to be monopolizing the resources available, hostBD.net
Web Hosting Solutions reserves the right to suspend that site immediately. This
policy is only implemented in extreme circumstances and is intended to prevent
the misuse of our servers.
CANCELLATION AND REFUNDS
17. The 30-day money back guarantee will apply to those who has subscribed to
hosting packages which are on monthly basis. No refund will be given to
semiannually or annually service plans.
18. This agreement, User account, contract, and billing will automatically renew
unless canceled in writing 30 days prior to the renewal date.
AUP MODIFICATIONS:
19.
hostBD.net may modify these terms and conditions upon notice published Online
via hostBD.net. User's use of hostBD.net services after such notice shall
constitute User's acceptance of the modifications to this Agreement.
